I AM Terms and Conditions
I understand that the activities may occur beyond the ski area boundary and in back country terrain. As a result, medical assistance may not be immediately available. I understand that I may be skiing/boarding in deep snow and in avalanche-prone areas, and understand that avalanches are unpredictable and that the risk of avalanches is inherent in traveling and skiing/ snowboarding in backcountry terrain. I agree to assume the risks of injury or death posed by participating in the activities beyond the ski area boundary and in backcountry terrain.
I acknowledge and understand that while participating in the activities, I am an INDEPENDENT CONTRACTOR acting on my own, and that I am not acting as an agent or employee of Alpine Meadows Ski Resort, Alpine Sierra Ventures, LLC, JMA Alpine Manager, LLC, JMA Ventures, LLC, the United States of America, Department of Agriculture, United States Forest Service, and their owners, investors, officers, directors, managing agents, employees, agents, landowners and all affiliated companies (collectively referred to as “Alpine Meadows”). I understand that if I am injured or die while participating in the activities, neither I nor my heirs will be entitled to recover or make a claim for workers’ compensation benefits.
As consideration for being permitted to participate in the activities, I AGREE NEVER TO SUE, TO RELEASE FROM LIABILITY, AND TO INDEMNIFY, DEFEND AND HOLD HARMLESS Alpine Meadows, for injury or death resulting from my participation in the activities or use of the facilities, regardless of cause, including the alleged NEGLIGENCE of Alpine Meadows. I further understand that THIS IS A RELEASE OF LIABILITY THAT IS VALID FOREVER, and that it will prevent me and my heirs from filing suit or making any claim for damages in the event of injury or death to me arising out of my participation in the activities or use of facilities. If I or any person acting on my behalf files a lawsuit arising out of my participation in the activities or use of the facilities, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS Alpine Meadows for any damages, attorneys’ fees, or costs associated with or arising out of such a lawsuit. I also agree to indemnify Alpine Meadows for all claims brought by a third party which arise from my participation in the activities.
I hereby authorize the use and reproduction of my image and/or likeness by Alpine Meadows and its authorized representatives without compensation. I understand that all such images (whether video, prints, negatives, or positives) will remain the exclusive property of Alpine Meadows. I agree to given written credit in any and all publications or videos in which an image of Alpine Meadows is used. Credits should appear as follows: Alpine Meadows, Lake Tahoe, California.
I understand and agree that this agreement is severable and that if any clause is found to be invalid, the balance of the contract will remain in effect and will be valid and enforceable. I agree that any action will be brought in the County of Placer, State of California, or alternatively, in a court of competent jurisdiction in the State of California. Any disputes will be subject to and determined under the laws of the State of California.
